alright here is my story

we were buyin a house from my mom it was her house
i missed 3 days of work to sign the paperwork
i scrounged out a downpayment
i saved every last penny for 2 months now
i havent gone to the movies, out to eat, NOTHING
i got approved for the loan which docks your credit some
i consulidated and scrounged to pay down my credit cards to the point where we would be approved for the loan
i put in my vacate notice for the apartment
i moved about 1/2 of my stuff to the new house
i built a dog house for my puppy
i paid mad_john money to send me parts so i can drive my car to the new house
i paid about a grand worth of stuff already to get this house (appraisal, termite inspection etc)

and TODAY!!!!

my mom calls me up and tells me she wants a EXTRA 10 f***ING THOUSAND DOLLARS IN CASH to which i replied sorry cant afford it so she tells me "deals off" AND HANGS UP ON ME

i have 1 week ONE f***ING WEEK to find a place to live

as of the 30th i have NO ROOF OVER MY HEAD

Guess it would be best to consult a real estate lawyer to see what your options are, even then your going to get screwed because you probably won't be able to move into the house before the 30th if there is a big argument about it.

Your purchase agreement IS your contract. What you sign at the tilte office is only for transfer of property. If both of you signed a purchase agreement AND there were no clauses for reasons to abandon the purchase agreement AND you put down earnest money, you have a legal contract that she can be held liable to. But then you would have to go through the money and process of suing your mother.

not according to NM law

until the official contract is signed

the purchase agreement can be cancelled at any time

well

on a brighter side

here are a few things that are better...

wife would get a new car
elantra would get more parts
credit cards would get paid

etc..

You can always cancell your notice to vacate. Those laws are in place to protect landlords from someone leaving without notice. If you can't leave, let them know the situation. You are approved for a loan, if this falls through find one for the same price and start over again and know not to deal with your mother EVER again.
