why are radar detectors illegal in Virginia?

yea i guess i understand the analogy, but it specifically says, shall not be construed to authorize the forfeiture of such device. ive read a few things on radar detector forums where the office did NOT take he detector, but only issued the ticket.

well when it comes to that . . .tickets are usually an agreement between you and the cop that you won't ghost and he won't take you to jail right then & there, but he could.



Discretion: cops have lots of it.

we will see how discrete he is when hes standing next to me in front of the judge, or whether he acts like the judge is an old college buddy and tries to embarrass me.

Dearest Delegate and Senator, it is an honor and a pleasure to contact you today. I write you today to ask your audience in hearing my plight. I was recently summoned for the unlawful use of a radar detector. The Officer detected my antiquated radar detector with his electronic detecting equipment and stopped me. He confiscated my detector and summoned me for its unlawful usage. I did not know this was unlawful, as I am a new resident of only 2 years here in Norfolk, Virginia. I am aU.S. born citizen, Navy Veteran, and currently a full time college student at Tidewater Community College, I have no criminal or civil infractions, and I have a clean drivers license. After researching the law, I find it disheartening to see that Virginia and D.C. are the only 2 places where the use of radar detectors are illegal, not counting usage in commercial vehicles nor military installations. I have been studying the Virginia Legislative website, and the General Assembly website looking for reasons why radar detectors are illegal in this great state. Has the fervor ofthe people of Virginia to quash unconstitutional laws been numbed? How and why has this law been able to keep its place in our modern society? I find it an insult to my standing as a model citizen of Virginia and the Commonwealth to be considered unlawful for using a radar detector. It is obvious to the other 49 states that its usage aids a driver in safety as modern radar detectors notify when ambulances, fire trucks, construction vehicles, or accidents and police and safety vehicles are nearby. Its use enables the driver to determine the appropriate course of action to take in regards to his driving, and completely allows the driver to be free of incident when traveling. I cannot find any sufficient data to support why the law in the Code of Virginia 46.2-1079 should remain. When I ask strangers in online forum boards, why radar detectors are illegal in Virginia, I get insulting remarks, such as, Virginia sucks, the legislature is crooked, its a source of revenue to ticket the people. The list of silly and insulting answers go on, but I will spare you the insults. I would have hoped to have heard specific and logical answers, such as the use of detectors has been known to interfere with police activity which can lead to civil safety problems because such and such frequencies cause such and such a problem for radios or what have you for police and civil servants, but I did not, and can not find such answers. It is with this research, that I find it unconstitutional for such a law to exist. In closing, I ask for your support in the matter of repealing this law once and for all in 2012, and in turn you have my support in your future campaign and the graciousness of the people in this great state, a state that holds the heart of freedom and democracy of this fine nation close.Thank you for your time.
