Default Arizona passes law allowing cops to arrest illegals

Arizona lawmakers on Tuesday passed one of the toughest pieces of immigration-enforcement legislation in the country, which would make it a violation of state law to be in the U.S. without proper documentation.

It would also grant police the power to stop and verify the immigration status of anyone they suspect of being illegal.

Under the measure, passed Tuesday by Arizona's lower house, after being passed earlier by the state Senate, foreign nationals are required to carry proof of legal residency.

Although I am very anti-illegal immigration, I can tell you the law won't stand. Unless the law has some provision for requiring probable cause it will be thrown out as unconstitutional for violating the 4th amendment. I can't see any situation where a cop would have probable cause to ask a person's immigration status.

For the record, if it were up to me, it would be legal for people who own property on the border to shoot trespassers on sight.

Joe Arppio (a.k.a. devil in man's clothing) has basically been arresting people for appearing illegal for years. finally he has paperwork on his side. this dude once pulled 500 police officers off duty to do sweeps through the city and rounded up and arrested tons of illegals. that man is like hitler and his nazi germany is the butt hole of the world, arizona.

thank god i left that state.

As much as I want illegal aliens to GTFO, I am against having to carry papers to prove anything to anyone and am fully against being required to show your "papers" to anyone (including police) at their whim.

I'm much more comfortable with building a wall...a wall with automated machine guns.

I would have to agree with I8acobra, except for the fact that they're illegally here..so really..they're not here, meaning, they shouldnt legally be covered by our givin rights amendments, or actually any amendment in that perspective..but yes, we should get a wall..a huge one..with guns..guns..and more guns..lots and lots of guns

Hate to tell you, but any officer can stop you and ask to see your ID at any time. No, a cop doesn't need probable cause to ask you to identify yourself.

haha cobra speaks the truth..I've been pulled over several times for complete bs..was sittin waitin ona train, and a cop pulled up behind me and pulled me over for no front license plate..wtf?..also got my plates ran randomly at like 9pm, and got pulled over for "no insurance" when we had just gotten our proofs of insurance in the mail a few days before..again, wtf?..cops have too much free reign in my oppinion..but this is one thing that I agree with.

IMO there is a big difference between being asked to identify myself and being required to present papers. Also, in most states they cannot arrest you for not identifying yourself unless you're already being detained under suspicion of committing a crime. Unless you're being detained any conversation with police is consensual. If you ask to leave and they say that you can't you're being detained, and they have to have suspicion that you've committed a crime to do that. In the states where they can arrest you for not identifying yourself you are still not required to show an ID, just to tell them your identity.

The obvious exception is when driving, you are required to carry your driver's license and provide it upon request to a LEO. If you're not carrying your driver's license that's already against the law.

Written law and practice are two different things. If a cop asks you for your ID and you refuse, you ARE going to jail. All he has to say is that you got belligerent and he suspected you may be on something.
