Yes, the sandbox can be broken.
Another thing to think about is that code can be obfuscated so many ways, most moder AV apps wouldn't catch it anyways.
The real way to deal with this is to have (and I shudder at this...) non-execute set on every apps /data/blah folders unless explicitly allowed by either dalvik or a permission in the app.
I choose to not have AV and watch where I pull my stuff from. It's a risk I feel comfortable taking, since anything important isn't on an easily lost/stolen phone.
You going to I/O this year? Some of the other DroidMod guys and I may if it's not sold out in 30 seconds...
