Default Shooting people in your house?

Can anyone give me cliffs about this?

If someone breaks into your house, is it legal to shoot the person?

Does the person have to try to attack you first, so you are shooting him in self defense? Or, if I see someone in my house, and i sneek up on him.. can i shoot him?

Always wondered about this. Thanks.

depends on the state/county/local laws

in some states you have to be in some sort of physical danger

others you have to tell them to leave first and you cant shoot them if they are fleeing (fleeing felon laws) UNLESS they put you in some sorta danger in the first place (ie they shot at you first or are shooting you as they flee)

best place to find out would be to call your local police, youd be surprised how many times cops get asked similar questions most of the time they are pretty cool to answer your questions

And once you think you've got it all figured out, think about what would happen if a "no knock warrant" ever got served at your house, and throw it all out the window.

This is a society of lawyers, you're always wrong until proven right. It's nice to be the only one left to tell the story of what happened, but if it's ever you verses the law, you'll be wrong no matter what. sad.gif
