So much for the fourth amendment... It seems like our government doesn't really care about our freedoms anymore, do they? Ever since 9/11, we've been constantly losing freedoms (Patriot Act, NDAA), and now it looks like the 4th amendment will be the next freedom to be trampled all over. Police state anyone?

The Fourth Amendment protects against “unreasonable searches and seizures” without the issuance of a warrant obtained due to probable cause.
The Court considers cell phone use to be a public – not private – action, thereby being ineligible for the protections of the Fourth Amendment. A court brief of the case states that “a suspect’s presence in a publicly observable place is not information subject to Fourth Amendment protection.”

Cliffs: If you are sending data down a private telephone line, that is private. If you are sending data through the public airspace to/from cell towers, that happens in public. Listening in on cell calls is the same as lookin in at a window from the street.

Facebook is also considered an 'open forum', and that includes the stuff that you set to 'private'.
I don't know if this is a worldwide thing, but european telco providers are required to keep a 6+ month log of EVERYTHING that you do with your phone. Calls, locations, message content - the lot.
