Lawsuit: Muffler kit didn't have exhaust warning

By ED WHITE
Associated Press

If someone dies from inhaling exhaust in a garage, is it the fault of the companies that make or market a muffler-repair kit?

The family of a deceased Livingston County man thinks so. The Michigan appeals court has reinstated a lawsuit that claims the repair kit should have carried a warning about the dangers of carbon monoxide.

Craig White died in 2005 while working on his Buick. His family says companies associated with the product had a duty to warn that cars should not be run in a closed space.

A Livingston County judge ruled against the family in 2008, but the appeals court, in a 2-1 decision, sent the lawsuit back for more work this week.

The majority says there wasn't enough evidence in the record to dismiss the case. The dissenting judge says White was knowledgeable about engines.

Holy Christ...is this serious? Now companies have to warn you that carbon monoxide is bad?

SCIENCE tells us carbon monoxide is bad.

LIFE tells us not to run a car in closed garage.

How stupid do you have to be to accidentally kill yourself by leaving your car running in your garage?

How much more of an imbecile to you have to be to SUE a company for not warning you?

They have Darwin awards for a reason...

I couldn't help but to agree. If there was only some way time travel was possible, travel back to when that lady sued McD's for giving her hot coffee, and put a 9mm to her brain stem(not that I advocate violence as the answer). Or at least have someone in the courtroom say;

"Hey retard, at what point did you not understand that coffee off the burner is hot?"

Now companies have to make sure that their products have no unwarned pointy edges, so that the stupid can survive. The dumb will always find a way to kill themselves off, it's called natural selection. All these warnings and court cases only delay the inevitable, that the stupid will remove themselves from the gene pool, eventually.

the Micky D's coffee just proves how stupid humanity can get. this dumbness can be found everywhere though. most notably in politics. much of the world belongs in a psychiatric institute.

okay lay it out. it doesn't matter what happened after the spill... so McD's didn't cover her medical bills, the fact that she sued because she opened the coffee? i uh, drove my Hyundai into a tree and Hyundai doesn't want to cover my medical bills, therefore i sue Hyundai.

No, she sued because that particular McD's was serving coffee that was much hotter than what corporate allows. They had been warned on multiple occasions that the coffee was too hot. They were trying to make the coffee last longer to save money. If the coffee had been at the proper temp, she would have received 1st and 2nd degree burns. However, she suffered 2nd and 3rd degree burns which required skin grafts. Like I said... do some research before assuming you know what happened.
