I need legal help
To those who have been following, my car went in to Hyundai with a funny noise coming from the engine bay. First they replaced spark plugs, second was the clutch they replaced, now they replaced the transmission and it still makes the noise. The service guy told me today that he was going to look in to it a little more but more than likely they're just going to give it back to me and say "it's the nature of the beast."
My car is still under warranty......can they even do this? They cannot prove it is neglect, I have all of my service records. There is nothing I could have done to cause this. It's not my fault they can't find the rattle after 3 tries, or whatever. Anyhow, do I have a legal leg to stand on? If I do, I'm going after them in court.

I think that falls under the US Lemon Laws doesn't it? If they try unsuccesfully to fix it, for the same problem, a certain number of times then I believed you are entitled to get your money back, or another vehicle. I would definately seek a lawyers advice if I were you.
I'm sure you could find a lawyer or attorney's office who would give a first time visit "consultation" for free. Look around for it.. but I'm not sure what kind of lawyer you would look for, for this type of problem.
nah, lemon law states that the part that is broken must be fixed. if the part (that is causing the problem) keep breaking , up to 3 times replaced. then you are intitled to a new car or you year. if no new car of your year then you will be givin a "check out" buy your insurance company to see the proper value of your car then a "DOT" rep will come out and check it out and then you will givin your money. ohh and another thing is that hyundai warrenty reps will have to be ther for the 3rd fix on the part to make sure them mach does it right.

My car does not qualify as a lemon. I just don't think a dealer can give up on a repair while the car is under warranty. They say since it is not harming the car in any way that it will be ok. HOW DO THEY KNOW IT"S NOT HARMING THE DAMN CAR WHEN THEY CAN"T EVEN FIND WHATS WRONG????

Well, you can have them put into the computer that you have made several complaints about said problem and it is noted. Then, if it fails later and the problem is found, they will have to fix it under warranty as it started under warranty.

is it loud enough to hear from the outside of the car? like if you're cruising down the strip, are people going to look and laugh at your car? if so, I'd really look into taking it to another dealership and making them inspect it thoroughly, til it's gone (or a certain amount of time has passed)
