a) he was not choked

b) speak for yourself fatty. Garner was fat even by murikan stadards. Oh and he had a heart that wouldn't stand up to being violently arrested.

c) if you want to think one could die an hour later from a choking there's nothing much left to say to you.

Legally... no it isn't, unless you had prior knowledge that the person had asthma. Even if you did, it'd be manslaughter, not murder as you lacked intent.
