the jist:
Arizona is full of HUGE private housing developments that usually force you to join a Home Owners Association when purchasing property in their "community". Once they have you as an HOA member they can enfore and/or change any rule upon you such as this popular one:

forcing everyone to display a parking pass to park in front of their own home (and they must purchase the parking pass every year). Why? Probably cause there's 700+ homes in the community and it's an easy way to make a lot of money. But what happens if you don't display your parking pass when you park in front of your own house? you get booted with one of those orange clamps and are forced to pay the $140 removal fee. What if you can't pay the removal fee? Your car gets towed and you have to pay more fees.

One man decided to stick it back to the HOA. He came home one night after a long day and forgot to place the pass on his rearview mirror. Why did he even take it off you ask? Well, living in one of the worst auto theft states he doesn't like displaying where he lives while parking his car around town (it's a nice car btw). He got booted.

Then he got to thinking..

This makes no sense. If you are a private company, and you purchase things to bolt to other peoples' property WITHOUT their permission, you are fair game for potentially not receiving their property back? Why is it theft?

Furthermore, if I lock a bike to my neighbour's cars' bikerack, and he cuts the wheel to get it off, then why would he be held liable for damages? Again, I see no difference when a PRIVATE company clamps their property to your car and you want to get it off. I'm not sure why the cops had a problem with this - it wasn't the municipality - it was a private company.


So the guy called the cops to see if he could legally do this, dolly his booted car back into his garage where the boot company can not retrieve (or tow) his vehicle. They said yes, it would just be a civil matter so long as he did not damage the boot, i.e. cut it off and put it on the HOA President's car.. LOL

pages 51-53 has all of the guy's post. Good for him for sticking it to the man, that company is out of control, i wonder what's going to happen? It's amazing how many people are following this story, specially if you saw how many sites it's been linked to including this one....rofl at all the t-shirts...

It looks as if the "Dolly Man" has been invited onto AZ's local rock station 98KUPD, known for less than normal radio interviews... If it happens it'll be on the morning show I bet which is from 5:30am to 10am PST.
www.98KUPD.com will stream the interview for sure (if it happens).

How do he get his wheels off to remove the boot? i though those things covered the lugnuts?
