Accident

My gf car got rear ended. What should we do? Looks like a lot of damage, the person only paid us $400 canadian so far towards the damage. He doesnt want to claim insurance. police report filed. body shop estimate $2600+ hidden damage. so expensive huh.

what we gonna do about injuries? head and back pain

who cares what he wants?!?! if it's his fault...which it is, since he rearended you, then claim it.

you should also return that $400, it could look like that you took that money as an option other than claiming it

claim it...It isn't your fault when someone slams into your assend

^^^ I second that...I just had some jackass rearend me in a parking lot the other day and ride out. If I knew who it was his ass would be grass no matter what he wanted.

Here's what you do, and trust me Im the expert on this now: I assume you have his insurance information...Call his inurance company and tell them that you would like to file a claimant's report. They will ask you for all the details of the accident. Did he admit fault in the police report? Were there any witnesses? Because if he did not admit fault the witnesses can vouch for you, although there was a police report so there shouldn't be any problem with him fessing up. Did you mention the injuries to the police when they were writing the report? If not you can still go to the emergency room and tell them you are experiencing pain relating to injuries sustained in a car accident. But when you file the claimant's report with his insurance company they will put the ball in motion and get you on your way to receiving a check for the estimated cost of repairs. So if you want any aftermarket body parts, make sure you have them included in the price in the estimate, but usually you have to be buddy buddy with a bodyshop owner to have them do this (this is how I am able to get my new kit and fenders).

Now about the $400, you can do either one of two things: When you call his insurance company, tell them that he gave you the $400 to settle it, or to "keep you quiet" and say that you do not want to accept it. Or you can make no mention of it, and deny any knowledge of it if the other guy does say something about giving you the $400. I would not recommend doing the latter, although it would be nice to have an extra $400 in your pocket. I would just keep things as legal, honest, and legit as possible so that things will work out in your favor.

kinda contradicting yourself, huh? lets be honest...... but tell the insurance prices for a new body kit rather than stock replacement parts. lol

yeah I did contradict myself, but there are certain ways to kinda "milk" the system...and as far as being honest I was mostly referring to the facts of the accident, and the fact that he gave him the $400, which the other guy will definetly bring up. And estimate is an estimate, most likey they are not going to sit there and pick it apart, so long as its believeable. For instance, in my estimate I had my body guy put $900 for a new front bumper, which is significantly more than an OEM bumper, but I can prove that the bumper that was damaged is worth $900. The way he could do it is put down the price for a stock bumper, but find a nice aftermarket one maybe used that is either the same price or cheaper. And it is possible because I can tell you right now that stock parts are expensive brand new, for instance in my estimate it was over $300 just for one headlight, but meanwhile the glass ones I'm actually getting are $300 for the pair. He also put down for a new driver's side fender when in actuallality he could have fixed the damaged one again. But now I'm getting an extra $200 that will pay for one of my Shark Z vented fenders.

Keep in mind, a check is just that, a check, it doesn't always mean that you have to have the work that's written in the estimate done for the same prices. You could find a bumper at a junkyard and do all the bodywork yourself and pocket the rest of the money.

oh, i agreed with everything you said. and if you read my first post up there ^ i did mention that he should return the $400...but maybe add to have a witness with him while returning that money...

but, on another note: mourning, whats goin on with this? any updates?

yes, we went to an acura dealer and they estimated $3100. the guy called but we didn't finish discussing, he wants to pay cash still. But we filled in our own insurance company on this accident so it's recorded. have medical record from doctor. and received police report. How can I tell if the other party admitted it was his fault? It doesn't say in the police report.

anyway, we will see a lawyer first after the holidays, we want to wait a few days to see if my gf pain will go away. the pain wasn't bad first day, now is little worst. The other party said he had an accident last year already that's why he doesn't want to go through insurance. What will happen to the other person insurance if we get any injury claim?

I do know a body shop i can talk to about aftermarket parts. I would like cash and buy parts from junk yard to fix it cheaper, but we will go through insurance if the injuries remains...
Anyway, there arn't much aftermarket parts for my acura sedan, muffler can use a change, but i'm not sure if that was damaged.
