Not sure if they get away with a surcharge unless they can come up with both a really good lawyer and a reason they can explain to an idiot in a jury pool how it costs them money to hire bilingual people

It actually make sense, especially in Hawaii.
I would argue that 50% of their tourism is Japanese and for a good percentage the idea of a tip is foreign. It's just the restaurant looking out for their employees.

I don't know how I feel about this one. They own a restaurant in one of the biggest tourist meccas in the world. If it weren't for non-english speaking patrons, they probably would have been sunk long ago.
Very easy solution to this. If 99% of their business is by non English speaking tourists as the news report claims, then simply apply a 15% gratuity on ALL bills, regardless of the number of people in the party. Very easy solution that forces everyone to tip and doesn't discriminate or supposedly discriminate against anyone.
