Brake checking that causes an accident= You could be liable?

You brake check.

They hit the guard rail.



The legal system tends to take a dim view of deliberately doing something that you know may cause an accident, even if the other person is also doing something wrong. :dunno:

If someone tailgates me, I let off the gas until they go around me. Having to deal with an accident is not on my list of things I want to do.

Yes, if you brake check and cause an accident, you could be liable. Especially if the other person has a dashcam.

Yep, just cause they are being a douche doesn't give you the right, especially if you cause an accident. Because, now YOU are the douche.

Brake checking is irresponsible driving. PERIOD

If someone is being a dick then reduce speed and allow them to pass. Attacking an a**hole with further dangerous a**hole behavior does not cautious driving make.

Can also cause road rage - and no thanks.
