apartment broken into, left with nothing
 

well friday night i came home from class around 650pm to my front door unlocked, a maintenance work paper on my coffee table, and my sh*t all gone. BRAND FING NEW computer i built myself, 26inch lcd, brand new headphones, gaming mouse, gaming keyboard, laptops, 360's, 32 inch lcd, digital camera (my first one btw, had it for a month before this), a bunch of other stuff... haven't had the chance to look through it all.

now i'm down to having my g1... f*ck my life. sorry for the rant....

So, you live in an apartment and a maintenance guy left your door unlocked? Sounds like the office either needs to pay for yo sheet, or you need to bust every damn window and wall in the place and pull a midnight move-out.

yeah well i can't move out now since my rent is auto paid by my school, i have no where else to go... the apartment manager only said "oh well it couldn't have been my maintenance guy, he's been with us for years".

f*ck em. i am looking for a new place to move to next month, till then i'm stuck here.... sadly.

Well, you can sit on your ass and take it, or you can do something about it. Personally, I would start pestering the landlord. Ask questions... get a lawyer. That maintenance guy should have locked the door.

I agree. Many places/businesses/schools offer access to free legal advice. Give the landlord a dollar amount, and ask him to pay or you will start pursuing legal options. Tell him you're serious, and it's obvious negligence of their maintenance guy. "The first legal advice I received offered to represent me for free and only take 10% of the judgment. And (this is for ALL apartment dwellers): look into getting some Renter's insurance.

i will ask around at school tomorrow, and i will begin to pester the landlord.

would it really be that easy to win? i mean me and my friend came to my apartment during a break from class, the apartment door was unlocked, and the maintenance work order was laying on the table. would that hold up in court?

if the school doesn't have anyone that can represent me, where should i go? just yellow pages for attorneys? i'm only 19 i don't really know much about that stuff

stocker, i HAD insurance until about 2 months ago, had never really thought it was for break ins thought it was for if my house burned or something... so i canceled it

If it went down like you said, then I would assume the landlord is responsible for their maintenance man not securing your room when he left. Is there a time on the work order? at least a date? THAT would totally hold up in court. BUT, you need to call the police, get a report filed ASAP!!!!!! They need to see if the lock was tampered with or if it was a forced break in. If not, than I'd say it would fall on the land lord. Its not criminal court but civil court, so I would assume it simply needs to be probable that that is what happened and you could be awarded a cash settlement.

Someone chime in who is maybe more savy with laws and rights under something like this. I'm just speculating and recalling episodes of Judy Judy! LOL!

I would do as stated ^ call local PD and ask for an officer to come by to file a report. Tell the officer you may use it to assist in a lawsuit. Ask him to write his opinion as to lock tampering or Breaking & Entering (or just negligence).

Also, does the maintenance request have a date and time? Tell the police to include in the report that the door was unlocked when you arrived, and the recent maintenance request/report was left on the table by an apartment complex associate.

Is your apartment complex owned by a large company, with several complexes in your area or regionally? Or is it owned by someone locally? Just curious as to how much legal backing they may have. I can't say whether it'd hold up in court or not, but search online for "free legal advice" and check on campus.
