Well, you guys heard it, my windshield is shattered. Stupid dump truck in front of me threw a rock outta his bed.

heres the story..sorry for the book lol

I was dr iving down RT 73 today and i was about 100 feet behind a dump truck, when BAM a rock through outa hte back of his dump bed, shattered my windshield...So i called the state police, and they said just to talk to the guy thats driving and get his ins. info. Well that was easier said than done.. i couldnt get him to pull over so i followed him a mile up the road to the landfill he was going to, i told him the story and he got all mad at me yelling and teling me it was from his new tires in the back and it was a road hazard and blah balh balh, and I kept tyring to get his insurance info but he wouldnt give it up, finally after arguing with him i got it and wrote everything down and he told me "good luck your not getting anything from us!" i called my ins. agaent then talked to the company whcih was Ziegler Construction, and then i called there ins. agent..i have a feeling there going to blame this on hte tires, but my buddy and I WATCHED the rock come out of the back of his truck. (his tarp was loose when he was going down the road but when he came back to the landfill entrance it was on really tight.) (we had to wait for him at the entrance.) what do you guys think i should do, am i gonna get screwed here??? :cry: :twisted:

you could always find the truck and take out the new tires that are to blame. may not get you a new windshield, but it would give peice of mind. i know those things gotta be expensive. :twisted:

on a serious note, i have no clue what to do. if it was a road hazard though, you may want to contact the state to see if they will do anything about it. i know people that get rims all bent up due to potholes can sometimes get the state to pay for new ones. dont know if its the same things though.

I say it's no different than if a couch, or tv stand falls out of the back of your truck when going down the road. He should be responsible, but you aren't the only one that this has happened to. I've heard this story a millino times.

They should pay for it though IMO.

You have a witness. If it goes to court, thats your "Ace in the hole".
He can testify that the Tarp was NOT on tightly and that the rock did in fact come out of the truck (In which case it would be DRIVER ERROR) instead of up and out from underneath one of the tires.

Another thing you can do is go by your local police station and see if any of thier automobile accident investigators are there. talk to them and see if you can talk them to come out and look at the windsheild. A competitent investigator should be able to tell the difference between something being shot out by one of the tires, or something bouncing out and down onto the windshield.

Also, was there any warning posted on the truck about staying back a certain # of feet??? If there wasn't you might be able to bring that up too, Most of the dumptrucks down here have warnings posted like that.

there were no signs saying to be back, it just said caution construction vehicle makes sudden stops and turns, im still waitin to here from there ins. agent. I will definatley take this to small claims if i have to. THIS IS BS lol, ill keep you guys posted..thanks for the info though!

well...i have to go through my insurance company to get this fixed..because GAY ASS ERIE INSURANCE is not covering it....i hate stuipd shit like this...im pissed haha..oh well..at least its not a honda with a broken windshield..that owuld be bad haha...

dude, what's to go thru your insurance? I just had a new window put in my Tib for $202 w/tax. Isn't that below your deductable or do you have a separate lower glass deductable?

Blue, lots of insurance places now replace windows for free if you have full coverage.

2 to 3 times a year.
