I Have The Worst Luck
I was crossing the street at my high school a little over 2 years ago to get to the senior parking lot so my friend and I could go out to lunch. There was no crosswalk, nor a crossing guard. Usually there is since it IS school property, and right in front of our school. Well, coming out of the parking lot there is a stop sign to turn onto the road we were crossing. This kid ignored the stop sign and just went. He slammed into the backside of me and threw me into my friend. My friend hit her head on the curb next to the parking lot and I just kept sliding. I woke up all bloody and confused. I went to the hospital with minor cuts and bruises... and some bruises to my bones. My right knee though was screwed. I needed 20 stitches to close it and my kneecap was sticking out. I also have tissue on my right leg that never healed and is still bruised. To this day, I cannot run whatsoever because my leg cannot handle the stress.
You know what sucks? I couldn't sue the kid because:
1. My insurance doesn't cover soft tissue damage... my CAR insurance. Health insurance won't cover me being hit by a car. That's auto insurance even though I didn't even use my car.
2. According to various lawyers and doctors, I have no permanent damage. Yeah, tell that to my leg.
3. I was a minor when it happened and since I am not a minor anymore (I wasn't about a year after it happened), I wasn't allowed to bring it to court, even though state law says I have 2 years after the accident happened to file a claim.
4. We crossed in an area that was not a designated crosswalk. THERE WAS NO CROSSWALK!!!
I was out of school for about 5 weeks to get my right leg to walk again. I still have some physical therapy sessions once a week.
I am just VERY thankful this is all the damage you got. When I was at the hospital, a girl sharing a room with me wasn't so fortunate. She was riding her bike on a sidewalk and someone slammed into her, paralyzing her from the waste down. She'll never walk again. I hope she sued the crap out of the guy that hit her, and I hope you can do the same. Don't let this get away. You could have permanent damage that you might not know about now... but you will later. man that sux but yea i am talking to a lawyer. you can sue the driver's insurance comp cuz that is what i am doing. try looking around in that neck of the woods. hope you find that you can sue the crap out of him. let me know what you find out
