Speed limit is posted as 25mph. Car being passed is going 40mph. Seriously lucky this idiot didn't take someone out with him.

He's lucky it wasn't a head-on! 
Double yellow (often any indicator anyway) and speed limit aside, he had no way of confirming that he had passing room/time with that hill ahead. Stunts like this should be an instant 6-12 month suspension.
